The department of history of the state, law and political law teachings was established as a part of the faculty of law in 1784. In 1784-1887 it was called the department of German and Austrian law. It was headed by professor K. Liske, who lectured the history of Austrian law; docent (later professor) F. Zrodlovskyi lectured the history of Roman law; docent G. Roshkovskyi lectured the philosophy of law. It was in 1887 when the department of Polish law was set up at the law faculty by a joint decision of the Rector’s Council and the Senate of the Lviv university (Academic Council). It was the second department on the territory of the Austrian province of Galicia and Lodomeria (first created in 1877 at the Yahelonian university in Krakow).

The head of the department became professor Osvald Baltser, a professor of Polish law, later professor A. Halban, professor P. Domkovskyi, who were the scientists of the European level. After the collapse of Austria-Hungary in the autumn of 1918, the Austrian teachers of the department of history of the state and law left the law faculty. During the Polish-Ukrainian war of 1918-1919 the department as well as the university didn’t work. After the restoration of work at Lviv university in the summer of 1920, professor Pshemyslav Domkovskyi headed the department of ancient Polish private law. In 1926, after the death of professor A. Halban he also headed the department of Western European law, temporarily. In 1933, after the death of professor O. Baltser, the department of Polish law (headed by professor O. Baltser) and the department of ancient Polish private law were joined into one department – department of History of polish government and law. It was headed by professor P. Domkovskyi. During the years of soviet power professor P. Domkovskyi remained the head of the department of general history of the state and law.

The students of those times highly appreciated the lectures of docent O. Nadraha and lecturers P. Ilkiv and L. Pauli who lectured Roman law. Having occupied Lviv in 1941, the Nazis closed down the university. On November 1, 1944 the university renewed its educational activity. The department of theory and history of the state and law was set up. Under this name the department functioned until 2008. Over the years the department was headed by professor P. Domkovskyi (1944-1946), professor P. Nedbailo (1946-1954), docent V. Kalynovych (1954-1960), professor V. Sokurenko (1960-1990), professor O. Tyshchyk (1990-1908).

In accordance with the decision of the Academic Council of Ivana Franko national university of Lviv and the rector’s order of April 10, 2008 the department of theory and history of the state and law was divided into the department of history of the state, law and political law teachings and the department of theory and philosophy of law.

The department of history of the state, law and political law teachings has been headed by professor B. Tyshchyk since 2008 – renowned professor of Lviv national university, Honored Lawyer of Ukraine, who is one of the leading scientists in the area of history of the state and law, being a real “patriarch” of this science.

His name as a respected scholar and an experienced teacher is widely known in Ukraine and abroad. Today, professor I. Boiko, professor M. Kobyletskyi, docent L. Shevchyk deliver lectures on history of the state and law. Professor B. Tyshchyk, docent A. Kolbenko, docent O. Lypytchuk, docent O. Ryhina, Candidate of Law Kh. Moriak-Protopopova lecture history of the state and law of foreign countries. Docent T. Andrusiak, docent A. Koval, docent A. Fedushchak-Paslavska; Roman private law – H. Fedushchak-Paslavska, professor M. Kobyletskyi, docent O. Ryhina.

The main areas of research of the department are the current problems of history of the state and law, history of political and law teachings.

Strategy

of development of the Department of History of the state, law and political law teachings of the Faculty of Law of Ivan Franko National University of Lviv for 2022-2027 academic years 

 

Introduction 

The Department of History of the state, law and political law teachings is one of the leading departments of the Faculty of Law of Ivan Franko National University of Lviv. The department dates back to 1784. The department has a scientific historical and legal school (headed by Prof. Tyshchyk  B.Y.). The department, as a teaching and research department of the university, has gained national and international prestige in the legal and educational environment. Reforming the education sector, changing trends in the market of legal services, as well as the needs of government agencies and other employers necessitate the adoption of the Development Strategy of the department, the implementation of which will ensure the training of competitive lawyers in modern conditions. 

 

Mission 

The mission of the Department of History of the state, law and political law teachings is to train highly qualified lawyers to work in public authorities, local governments, courts, prosecutors, lawyers, other law enforcement agencies, legal services, enterprises, institutions, organizations, associations of citizens etc. Teachers of the department are convinced that lawyers belong to one of the most conscious parts of society, which, as a rule, should form the basis of the Ukrainian national patriotic elite, able to continue the traditions of Ukrainian statehood.

Vision 

The Department of History of the state, law and political law teachings takes an active part in training lawyers in accordance with the requirements of the time. In modern conditions, it is important to preserve the long-standing traditions of the Department of History of the state, law and political law teachings of the Faculty of Law of Ivan Franko National University of Lviv and to understand new challenges. The combination of traditions and innovations allows the department as a component of the faculty to effectively perform its functions. An important task of the Department of History of the state, law and political law teachings is the development of academic traditions and democratic principles in the formation of relations between teachers and students, strengthening national and cultural identity, promoting civic activism and responsibility of future lawyers, deepening the culture of academic integrity. 

 

Strategic goals 

The strategic directions of the department’s development include: 

  1. Improving the quality of scientific and pedagogical staff of the department, in particular to promote the professional growth of employees, increase the share of doctors of science in the department (Assoc. Prof. Fedushchak-Paslavska G.M., Kolbenko A.V., Assoc. Prof. Shevchuk L.E., Assoc. Prof. Lipitchuk O.V., Assoc. Prof. Koval A.F., Assoc. Prof. Morіak-Protopopova H.M., Assoc.   2. to promote professional development of teachers of the department (internships) in leading Ukrainian and foreign higher educational and scientific institutions;
  3. to promote the employment of graduate students who defended their dissertations in time;
  4. to promote the expansion of cooperation of the department with similar departments of other higher legal institutions and faculties of Ukraine;
  5. to promote the use of new educational technologies and the participation of the department in international educational projects; involvement of the department in international scientific cooperation;
  6. to promote the improvement and improvement of the material and technical base of the department;
  7. organization and holding of international and all-Ukrainian scientific-practical conferences in Ukraine, where the department will act as the initiator and organizer;
  8. informing about the scientific and pedagogical activities of the department on the Internet and social messengers (Facebook, Twitter, Telegram, etc.);
  9. to restore the library for law students at the department;
  10. organization at the faculty of the Museum of the Faculty of Law;
  11. preparation of materials about outstanding graduates of the Faculty of Law.

 

Setting priorities 

The priority tasks of the Department of History of the state, law and political law teachings are: 

Educational and methodical work 

Methodical work 

  1. The priority task for the department is to ensure a high level of reading lectures and conducting seminars by teachers.
  2. Development and implementation of new special courses and new courses of students’ choice in the educational process.
  3. Improvement of educational and methodical complexes on disciplines of the department (including educational and working programs of courses, plans of seminars).
  4. Publication and use of workshops in the educational process for the formation of skills of practical application of legislative and other regulations.
  5. Carrying out of methodical seminars, round tables for discussion of actual and debatable problems of historical and legal science that will allow to raise methodical professionalism of teachers of department.
  6. Intensification of the work of teachers of the department on collective and individual textbooks and manuals in order to ensure independent work of students in professional disciplines.
  7. Publication of scientific research of teachers of the department in journals included in scientometric databases SCOPUS and Web of Science.
  8. Organization of open lectures of leading jurists of Ukraine and well-known specialists from abroad in order to transfer experience to young teachers.
  9. Preparation and defense by scientific and pedagogical staff of the department of dissertations for the degree of Doctor of Philosophy and Doctor of Law.

 

Educational work 

  1. Substantially change the teaching of basic disciplines of the department.
  2. Methodologically change the teaching of historical and legal disciplines:

     – focus on the analysis of historical sources; 

     – focus on finding out the cause-and-effect relationships; 

     – use new approaches to comparative legal analysis and assessment of historical and legal phenomena and processes; 

     – use new Ukrainian and foreign literature; 

     – contribute to the patriotic education of students. 

 

Scientific work 

  1. To intensify research of sources of Ukrainian law and work on the integration of scientific research of scientists of the department in the field of European historical legal research.
  2. To organize and hold scientific conferences on historical and legal issues, which are currently relevant and in demand in our country, the study of which, in turn, will contribute to Ukraine’s rapprochement with the European legal, socio-political and cultural environment.
  3. To intensify the publication of scientific works of teachers of the department abroad, especially in foreign languages; to involve foreign scholars as reviewers of historical and legal works of teachers of the department and to promote the entry of scientists of the department to the editorial boards of historical legal publications of other countries; to promote the participation of scientists of the department in international projects, which will promote the achievements of the Lviv School of History and Law. Particular attention should be paid to comparative topics, which include Ukrainian material, which will allow it to fit into the European context.
  4. Update and expand the topics of planned research of the department, which are performed within working hours. Approve the departmental topic of research on current issues of history of state and law of Ukraine and foreign countries, as well as the departmental topic of research on current issues of history of Ukrainian law and Ukrainian political and legal thought. Pay attention to the practical use of research results. Cooperate with the faculties of leading higher educational institutions of Ukraine.
  5. Ensure a high scientific level of publications in periodicals. Facilitate the participation of employees and graduate students of the department in scientific conferences, support their applications for individual grants. Contribute to the writing of monographs on the topics of doctoral dissertations. Seek timely defense of graduate and doctoral students of the Department of PhD and doctoral dissertations.

 

Student research work 

  1. Intensify work on wider involvement of students in groups on the History of State and Law of Ukraine, History of State and Law of Foreign Countries, Roman private law.
  2. To intensify the participation of students in scientific student conferences and round tables, debates.
  3. Strengthen the work of students and their supervisors on the publication of student research papers.

Educational Activities 

The priority in the educational work of the department is the formation of active public and state position among law students and their formation as patriots of Ukraine. Encourage students to study, gain deep knowledge and scientific work, instill in them a love for their profession. Regularly listen to the reports of the advisers of academic groups on educational work with students at the meetings of the department. 

Strengthen cooperation with the heads of first-year academic groups. Facilitate the adaptation of first-year students to the educational process at the faculty. 

Organization of meetings with practicing lawyers and well-known statesmen and politicians of Ukraine and foreign countries. 

Training as a lawyer with deep classical knowledge in the field of jurisprudence and personal education, a lawyer with high moral and ethical qualities, a patriot of his country and profession. 

 

Economic activity 

  1. Apply for the allocation of new furniture, computers, a separate auditorium for the design of the Museum of History of the Faculty of Law.
  2. Apply for repairs to the power grid of the department, for proper lighting and heating.
